Please read the following terms of service ("Agreement" or "Terms of Service") before you install The News Times application or use any of the products or services we provide through our application. The Terms of Service constitute a binding legal agreement, which governs your use of Uma Technologies via any platform or device. By installing The News Times application, visiting our website or installing or using any of the Uma Technologies, you are accepting these Terms of Service. If you do not agree to these terms, please do not install our application, access our website or use any of our products or services. THE NEWS TIMES SERVICE

The News Times application, supporting files and accompanying documentation (referred to collectively herein as the "The News Times application") is provided solely for your personal, noncommercial use. The articles and other content that you choose to save may be protected by copyright and other laws.

We respect the intellectual property of others, and we ask our users to do the same. The Uma Technologies allow you to time-shift across devices and platforms so that you can access the information later that you had the right to access when you saved such content to The News Times. As a condition to your use of Uma Technologies, you agree not to use Uma Technologies to infringe any intellectual property rights. We reserve the right, at any time, in our sole discretion, with or without notice, to terminate the accounts of, and block access to the Uma Technologies to, any users who infringe any copyrights or other intellectual property rights.

We offer a paid subscription service ("Premium Membership") which, among other things, provides paid subscribers with certain features that are not made available to users of the standard, free version of the Uma Technologies. Each paid subscriber has a separate, personal library in which an archival copy of saved content is stored for that subscriber’s own personal non-commercial use at a later time. The News Times Premium subscription service also includes other features, such as full-text searching of saved content and suggested tags for an item. Subscriptions to The News Times Premium are available on monthly and yearly subscription plans.

INFORMATION YOU PROVIDE

You agree to read our Privacy Policy, which explains what type of information we collect and what might happen to that information, including, without limitation, how such information is shared and used. Although our Privacy Policy is not a legal agreement and creates no contractual obligations, it contains information that you should review before using Uma Technologies. Our Privacy Policy will apply to the information we collect, whether or not you choose to read it. You are not required to create a user account or provide any personal information to visit our website. You are required to create a user account, however, to use our application or some of our services, such as articles or other content to The News Times, or for our paid subscription service.

If you choose to send us any message, feedback or data, including, but not limited to, any ideas, comments, suggestions or questions regarding any product or service, such information shall be deemed to be non-confidential. We shall have no obligation of any kind concerning such information and shall be free to reproduce, use, disclose and distribute the information to others without limitation. Further, we shall be free to use any ideas, concepts, know-how or techniques contained in such information for any purpose whatsoever, including but not limited to developing, manufacturing and marketing products and services incorporating such ideas, concepts, know-how or techniques. The Uma Technologies enable users to share, save or post information or materials, or to communicate with or otherwise share information with other users or persons. You agree not to share, save, submit, publish, display, disseminate, or otherwise communicate any defamatory, inaccurate, abusive, threatening, offensive, indecent, illegal or otherwise objectionable material, or any material that violates any federal, state, or local law in the United States or anywhere else in the world.

COPYRIGHT INFRINGEMENT

The articles and other content made available on third-party websites may be protected by copyright and other applicable laws. Some content may not be reproduced, used to prepare derivative works, distributed, performed publicly or displayed publicly without the written permission of the copyright holder, except to the extent allowed under the "fair use" provisions of the U.S. copyright laws, other limitations on exclusive copyrights in the U.S. copyright laws, or comparable provisions of foreign laws. Other content may have re-use permissions attached. Please refer to the website you were visiting when you saved such content for information that may apply to such content.

You represent and agree that The News Times application will be used solely for your personal-noncommercial use concerning the content of third party API that you have the lawful right to access and that The News Times application will not be used in violation of the restrictions posted on the website where such content was published. Some websites include security measures designed to prevent access, and you agree not to take any steps to defeat any such security measures. We do not necessarily monitor any materials posted, transmitted, or saved to or with Uma Technologies. By posting, sharing or saving any articles or content, you represent that doing so does not infringe any third party’s copyrights, trademarks, privacy rights or other intellectual property or legal rights of any kind. If notified that any user has posted, shared or saved any information or materials which allegedly do not conform to this Agreement, we may in our sole discretion investigate the allegation and determine whether to take any other actions, including, but not limited to, whether to remove or request the removal of the information or materials posted, shared or saved by a user. We also reserve the right to terminate the account of any user who transfers or saves content in violation of this Agreement. We shall have no liability or responsibility to users for the performance or nonperformance of such activities. You may be subject to civil and criminal penalties, including without limitation monetary damages if you violate the terms of this Agreement or infringe any third party’s legal rights.

PROPRIETARY RIGHTS NOTICES

All trademarks, service marks, logos, trade names and any other proprietary designations of The News Times used herein are trademarks or registered trademarks of The News Times. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.

DISCLAIMER OF WARRANTIES

Reasonable efforts are taken to improve the accuracy and integrity of Uma Technologies, but we are not responsible for mistakes, out-of-date information, inaccuracies, typographical or other errors. Notwithstanding any other provision of this Agreement, we reserve the right to change, suspend, remove, or disable access to any of the Uma Technologies, content, or other materials comprising a part of the Uma Technologies at any time without notice. In no event will we be liable for making these changes. As a registered user in good standing, you may be provided with limited access to the articles or other content saved to The News Times. Such access is provided as an accommodation only, and the items you save with The News Times may be deleted at any time and for any reason. We do not warrant, and will not have any liability or responsibility for, your use of The News Times or the products or services we provide. We may also impose limits on the use of or access to certain features or portions of the Uma Technologies, for any reason and without notice or liability. Our products and services may be unavailable from time to time due to mechanical, telecommunication, software, and other failures. We cannot predict or control when such downtime may occur and cannot control the duration of such downtime.

LIMITATION OF LIABILITY

THERE ARE INHERENT RISKS IN RELYING UPON, USING, OR RETRIEVING ANY INFORMATION FOUND ON THE INTERNET, AND WE URGE YOU TO MAKE SURE YOU UNDERSTAND THESE RISKS BEFORE USING UMA TECHNOLOGIES OR ANY WEBSITE THAT PROVIDES YOU WITH ACCESS TO UMA TECHNOLOGIES. YOUR USE OF THE UMA TECHNOLOGIES IS AT YOUR OWN RISK.

INDEMNIFICATION

You agree, at your own expense, to indemnify, defend and hold harmless Mozilla, its parents, subsidiaries and affiliates, and their officers, directors, employees, agents, distributors and licensees, from and against any judgments, losses, deficiencies, damages, liabilities, costs, claims, demands, suits, and expenses (including, without limitation, reasonable attorneys’ fees, expert witness fees and expenses) incurred in, arising out of or in any way related to your breach of this Agreement, your use of the Uma Technologies, or any of your other acts or omissions.

AUTOMATIC RENEWAL, PAYMENTS, AND REFUNDS

Subscriptions to our paid The News Times Premium service are available on monthly and yearly subscription plans. Each paid subscription is valid for only one user account and you are not permitted to use your paid subscription with any other user accounts. YOUR PAID PREMIUM SUBSCRIPTION WILL BE AUTOMATICALLY RENEWED, AND THE SUBSCRIPTION FEE CHARGED, AT THE END OF EACH SUBSCRIPTION PERIOD UNTIL YOU CANCEL. THE SUBSCRIPTION FEE WILL BE CHARGED TO YOUR LAST PAYMENT METHOD. We may offer a free trial period for The News Times Premium.

We reserve the right in the future to charge for use of our services that are currently available free of charge. You will not be charged for using any Service unless you have opted for a paid subscription plan. We will provide users with notice of any material change to the terms and conditions applicable to the subscription service at least thirty days before such change taking effect. By continuing to use our services after the change takes effect, you accept the new terms.

We do not issue refunds for subscriptions paid for through iTunes.

CANCELLATION POLICY FOR PREMIUM

You may cancel your subscription at any time. If you cancel or decide not to renew, you will be downgraded to our free service upon cancellation or at the end of your subscription period, as applicable. If you do not pay for your paid subscription on time, we reserve the right to suspend your paid subscription or reduce your service level to our free service.

TERMINATION

This Agreement is effective unless and until terminated as expressly provided herein. We may terminate this Agreement at any time and may do so immediately without notice, without any liability to you, and accordingly deny you access to the Uma  Technologies, in our sole discretion, if you have failed or we suspect you have failed to comply with any term or provision of this Agreement. Upon any termination of this Agreement, you must promptly destroy all materials downloaded or otherwise obtained from us, as well as all copies of such materials. Termination of this Agreement shall not act as a waiver of any breach of this Agreement and shall not release you from any liability for breach of your obligations under this Agreement.

Upon the termination of a paid subscription, any of the data stored as part of your paid subscription (including, for example, copies of content in your permanent library), will be stored for 30 days. Following such 30 day period, we will have no obligation to save any such data.

ASSIGNMENT

This Agreement may not be assigned, in whole or part, whether voluntarily, by operation of law or otherwise, by you without our prior written consent. Subject to the preceding sentence, the rights and liabilities of the parties hereto is binding on and shall inure to the benefit of, the parties and their respective successors and assigns. Any attempted assignment other than by this section shall be null and void.

SEVERABILITY

If the application of any provision of this Agreement to any particular facts or circumstances shall be held to be invalid or unenforceable by an arbitrator or tribunal, then (a) the validity and enforceability of such provision as applied to any other particular facts or circumstances and the validity of other provisions of this Agreement shall not in any way be affected or impaired thereby, and (b) such provision shall be enforced to the maximum extent possible to effect the intent of the parties and reformed without further action by the parties to the extent necessary to make such provision valid and enforceable.

RELATIONSHIP OF THE PARTIES

Nothing contained in this Agreement shall be deemed or construed as creating a joint venture, partnership, agency, employment or fiduciary relationship between the parties. Neither party nor their agents have any authority of any kind to bind the other party in any respect whatsoever, and the relationship of the parties is, and at all times shall continue to be, that of independent contractors.

FORCE MAJEURE

We shall not be responsible or have any liability for any delay or failure to perform to the extent due to unforeseen circumstances or causes beyond its reasonable control, including, without limitation, acts of God, earthquake, fire, flood, embargoes, labour disputes and strikes, riots, war, the novelty of product manufacture or other unanticipated product development problems, and acts of civil and military authorities.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior or contemporaneous representations, discussions, proposals, negotiations, conditions, agreements and communications, whether oral or written, between the parties relating to the subject matter of this Agreement and all past courses of dealing or industry custom. No amendment or modification of any provision of this Agreement shall be effective unless in writing and signed by a duly authorized signatory of Mozilla and you.

ELECTRONIC COMMUNICATIONS

If you create a user account or send emails to us, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on Uma Technologies. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You agree that we may send an email to you to advise you of changes or additions to the Uma Technologies or your Premium subscription, about any of our products or services, or for such other purposes as we deem appropriate.

REVISIONS TO AGREEMENT

We may, at any time, revise this Agreement. If we modify the Terms of Service, we will post the modification on our website, through Uma Technologies, or otherwise provide you with notice of the modification. Before each usage of the Uma Technologies, you should review the Terms of Service to determine the current Agreement to which you are bound. For your convenience, we include the effective date of the Agreement at the beginning of the document, so that you can easily ascertain whether it has been updated since the last time you viewed the Terms of Service. Your continued use of the Uma Technologies constitutes acceptance of this Agreement at the time of each use. If the modified Terms of Service are not acceptable to you, your only recourse is to cease using Uma Technologies. Notwithstanding the preceding sentences of this paragraph, no revisions to the Terms of Service will apply to any dispute between you and The News Times that arose before the date of such revision.
